1. Preamble
These Terms of Service govern your use of the GotaPlan platform, operated by Kulander Labs By accessing or using GotaPlan, you agree to be bound by these terms. If you do not agree, you may not use the service.
2. Definitions
• 'Service' refers to the GotaPlan platform and all associated services • 'User' refers to any individual who creates an account or uses the Service • 'Workspace' refers to the organizational unit within the Service • 'Content' refers to any data, text, files, or materials uploaded to the Service • 'Provider' refers to Kulander Labs
3. Payment Terms
Subscription fees are billed according to the selected plan (monthly or annual). Prices are listed in PLN (zł) and are exclusive of applicable taxes. Payment is due at the beginning of each billing period. Late payments may result in service suspension after a 14-day grace period.
4. Account Activation
To use the Service, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
5. Termination
You may terminate your account at any time through the account settings. The Provider may terminate or suspend your account for violation of these terms, with reasonable notice where possible. Upon termination, your data will be retained for 30 days before deletion.
6. Warranties and Disclaimers
The Service is provided 'as is' without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation. We strive to maintain the uptime targets specified in your subscription plan but these are targets, not guarantees (except for Enterprise SLA plans).
7. Limitation of Liability
To the maximum extent permitted by law, Kulander Labs shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
8. License
We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during the subscription period. You may not sublicense, reverse-engineer, or create derivative works based on the Service.
9. User Obligations
You agree to: • Use the Service only for lawful purposes • Not upload malicious content or attempt to compromise security • Not share your account credentials with unauthorized parties • Comply with all applicable laws and regulations • Respect the intellectual property rights of others
10. Fair Use Policy
The Service is subject to reasonable usage limits. Excessive automated usage, API abuse, or activities that degrade service quality for other users may result in throttling or suspension. Specific limits are documented in your plan details.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Poland. Any disputes shall be resolved by the courts of competent jurisdiction in Poland. For EU consumers, mandatory consumer protection laws of your country of residence shall apply.
